Terms & Conditions

Online Terms & Conditions

1- Payments

1.1- We accept payment by credit and debit card.

1.2- We will not be deemed to have contracted with you or accepted your order until funds have been claimed by us from your account which will be within 72 hours of you placing an order.
1.3- All prices online are indicated and shown on this website and are the price you pay in total + postage if applicable.

1.4- Goods will only be delivered to the registered address of the credit card used for payment.
1.5- Goods remain the property of "Ilkeston Factory Specs"

2- Delivery.


2.1- We do not guarantee to deliver goods ordered on this site by a specific date or a special occasion other than as outlined within these terms and conditions.  

2.2- If we have received your order or your goods to work on and not returned (sent back by post) the products ordered by you within 28 days of our acceptance of your order or receipt of your sent goods, you may cancel the order and all money paid will be refunded to the credit or debit card that the payment originally came from.

2.3-  Goods can only be supplied to United Kingdom residents and delivered to a United Kingdom address including England, Scotland, Wales and Northern Ireland.
2.4- We will send (all) goods ordered by Royal Mail Signed for 2nd class delivery or Royal Mail Special Delivery. We may choose to hand deliver goods by appointment in some circumstances as a replacement for paid Special Delivery and it is your responsibility to ensure that someone is able to sign for receipt of the goods. We will email you the day we send out your goods but cannot guarantee the exact delivery day and time.

2.5- We will be entitled to rely upon your signature as proof of delivery/ a neighbours signature if taken on your behalf/ or a statement of delivery signed on your behalf by the Royal Mail employee attending and making the delivery. In all cases the delivery will be deemed to have been successfully made.
2.6- You should Inspect the goods upon delivery and notify us straight away on the day of receipt (by email through Ilkestonfactoryspecs.co.uk website contact form) should they be in any way defective. If this is the case you should not use the product or wear the product.

2.7- All Damage to goods and or missing items to or upon the delivery must be reported on the day of receipt of the goods to ourselves and the Royal Mail.

2.8- Should it be necessary for you to return goods then you shall be liable for the cost of return, and their safe-keeping until such time as they are delivered to us including any period in transit.

2.9- The returned spectacles or goods should be returned unmarked and in their original packaging for our inspection and acceptance and returned at your own cost by return.

2.10- Goods returned as faulty, damaged or not accurate or as described will not be considered returned until we sign for and receive them at Ilkeston Factory specs trading address.

2.11- Should returned goods not arrive back to us no refund will be made for original monies paid.

3- Reframe Own Lenses - Plano No Prescription Lenses

- Prescription Lenses

3.1- You agree when sending your own frames or lenses to us that the value of the items you send have a value of £0 if lost in forward or return transit or if damaged within our glazing processes.

3.2- Initial order - In the event of your own goods you post to us for us to work on getting lost in forward transit or not arriving at our premises for us to fulfil your initial order, (in particular your own lenses for our reframe service you agree to wait a minimum of 28 (goods sent with Special Delivery tracked postage) to 56 working days (for untracked goods) from the date of your postage receipt before requesting a refund for payments made to us in advance for the work we cannot perform without your items.

3.3- Ilkeston Factory Specs can only accept inward goods sent to us to work on during working days (hours) which are Mon, Tue, Thur, Fri, Sat. Failed delivery attempts on our non working days inc Bank Holidays, closed Christmas holidays and any Wednesday or Sunday may be subject to re-delivery by your courier or Royal Mail on a day of their choice which may delay our receipt and completion of your order, and is to be deemed beyond our control.

3.4- In the event of your goods not arriving at our premises (and you have proof of postage upon request) so that we can perform our part of the original contract, you agree when placing orders on this site to accept an administration and handling charge of £15.00. This will be deducted from your payment before we make a refund (of the balance minus £15). This covers bank charges made to us from your credit provider when you made your payment and our time spent administering the matter.

3.5- You agree to show us upon request a forward proof of postage receipt before we can deem a parcel sent and lost and any refund can be made. Goods sent and lost cannot be refunded without proof of postage to our address.

3.6- When choosing Special Delivery, goods sent out to you on completion usually take between 1 and up to 7 working days to arrive. You agree that the goods will not be considered lost in transit until a minimum of 28 working days has passed.

3.7- When choosing Signed for 2nd class delivery, goods sent out to you on completion usually take between 2 and 14 days to arrive. You agree that the goods will not be considered lost until a minimum of 56 working days has passed.

3.8- You agree not to claim financial compensation from Ilkeston Factory Specs for lost or damaged goods, and you undertake to indemnify us protecting us against any financial claim for the cost or replacement cost of your own items (frames or lenses).

3.9- You are responsible for posting your goods to us and agree that you accept full liability and will not hold us in breach of contract if we are unable to carry out works on goods sent to us that are lost in transit.

3.10- You will not consider us to have broken the contract made with you if the goods you send us to work with are lost in transit and you hold no proof of postage to establish their loss. Refunds cannot be processed without this proof of postage upon our request.

3.11- where proof of postage is held by you and goods posted to us have not arrived in the outlined time scales, upon receipt of your proof of postage we will start the refund process with the handling charge applied.

3.12- You will not send lenses of high value etc without first contacting us by email, as these types of lenses will be deemed at a value of £0 in the event of loss or damage due to them being unusable as a working pair of glasses.

3.13- Ilkeston Factory Specs does not guarantee specific delivery dates or next day delivery with goods sent out when using 2nd class signed for or Special Delivery post.

3.14- You accept our choice of frames we supply when using our reframe service online and understand they cannot be changed at a later date.

3.15- Reframes Online must be posted to us and will be shipped back to you once completed and cannot be collected from store.

3.16- If we are not able to reframe your own goods you will not hold us liable for your original postage costs when you shipped your goods to us or the cost of returning your goods.

3.17- If we cancel a reframe or plano no prescription reglaze order online for any reason we will refund any payment made by you in full to the credit or debit card used, and you agree to make a new payment for the cost of return postage at our advertised rates if you would like us to return your sent items by post.

3.18- when using our reframe service you accept responsibility for accidental damage to your lenses by us whilst attempting a reframe for you, and accept that pd's and height measurements can vary a little due to the lenses being fitted into our new frames.

​3.19- When using our reframe service you will not hold us responsible for any altered vision through your lenses.

3.20- Reframes are guaranteed for 3 months from receipt for inherent faults, but we can't be responsible for misuse, wear and tear or accidental damage to the frames.

3.21- You are responsible for maintaining your glasses frame we supply as a reframe, ensuring working parts, fixings etc are not lost.

 

4- Cancellations

4.1- Our bespoke products and services are exempt from changes and cancelation and are exempt from the usual distance selling legislation. Changes to your order made before completion are at our discretion. If we decide to accept changes to your order before completion you may incur an additional charge for additional work, time and materials used in preparation of the original order and the additional materials used.
4.2- We cannot be responsible for altered pupil distance settings or height measurements when your own lenses are fitted to our new Reframes but will do our best to match as near as possible. You accept that any differences do not constitute a breach of contract. 

4.3- In the event of a cancelation for bespoke goods, we may decide and agree to a cancelation at our discretion in some circumstances. If we agree, we will deduct the cost of any work undertaken on your instruction and an administration charge of £15.00 before refunding you the balance in the manner and to the account you paid from for the goods or services.

5- Guarantee

​5.1- We reserve the right to repair or replace faulty goods if not returned within 30 days.

5.2- Guarantees will not apply where goods have been subject to misuse, have not been used for the intended purpose or have not been used or cared for in a reasonable manner or in accordance with any specific instructions issued with the product.

5.3- We cannot be held responsible for accidental damage, or loss of our products in full or in part.

Goods must be returned in emaculate condition, as received and with all extras sent at your own expense.

 

6- General Terms


6.1- We reserve the right to cancel any order for any reason and return any payments made to us on credit or debit card.

6.2- We reserve the right to amend prices and specifications with your permission and will refund the payment made if you do not agree to a changed price.
6.3- No employee of "Ilkeston Factory Specs" has the right to vary these terms and conditions.
6.4- These terms and conditions shall be governed by English Law.

6.5- We can only supply lenses in-store and to a valid prescription that is less than two years old.
6.6- We cannot supply lenses in-store to those who are under 16 or registered partially sighted.

6.7- You declare that your prescription is not more than 2 years old as governed by the supply of prescriptions spectacles laws in the uk and is a valid prescription supplied by a qualified optician under 2 years ago.
6.8- A binding contract is only entered into when we accept your order payment or deposit.

6.9- Prescription lenses we state we supply on this website are sold in-store only.

6.10- We reserve the right to use lens brands of our choice unless a particular lens brand has been specifically requested and documented on order.

6.11- descriptions like Standard, Premium and elite are used to describe lenses and  as an order/guide of superiority and don't specifically entitle the buyer with any particular lens brand.

7- Prescription

7.1- We reserve the right to rely upon in good faith the prescription you have provided for us to work with as accurate, correct, and suitable for you vision needs.

 

8- Force Majeure

8.1-  in the event of unforeseen events or events beyond our control including but not limited to disasters, emergencies, exceptional weather conditions and strikes effecting production or delivery (through a third party postal service) of ordered products on this site, while the circumstances persist the terms set here throughout shall be suspended until we or they are reasonably able to continue to perform the contract or contracts made without further undue delay, and the original terms can be reinstated.

9- Statutory Rights

9.1- Nothing in these terms and conditions shall effect your statutory rights.​

Terms and Conditions In-store

1- Payments

 

1.1- We accept payment in cash or direct bank transfer.
1.2- Goods remain the property of "Ilkeston Factory Specs" until fully paid for.

2- Reframe Own Lenses and Plano No Prescription Lenses

 

​2.1- when using our reframe service you accept responsibility for accidental damage to your lenses by us whilst attempting a reframe for you, and accept that pd's and height measurements can vary a little due to the lenses being fitted into our new frames.

​2.2- When using our reframe service you will not hold us responsible for any altered vision through your lenses.

3- Cancellations

 

3.1- Orders placed in-store for bespoke products and services are exempt from cancelation. 

3.2- Cancelation of your order made by you before completion is only accepted at our discretion.

3.3- If we decide to accept cancelation of your order before completion you will incur a charge for administration and time spent of £25.00 in preparing your order plus a charge for materials used.

​3.4- If we accept your cancelation a refund will be made in the same way as the payment was presented, in person or to the account the payment was made from.

3.5- Goods left at store including frames and old prescription lenses will be disposed of unless you expressly ask us to retain them.

3.6- Any goods owned by you that you expressly asked us to keep on your behalf left at our premises will be kept for 6 months for your collection at your own expense, after which they will be disposed of and no longer be available to you.

 

4- Changes to Orders

 

4.1- Changes or alterations made to any bespoke order placed with us are made at our discretion. 

 

5- Guarantee

 

5.1- We reserve the right to repair or replace faulty goods.

5.2- Guarantees will not apply where goods have been subject to misuse, have not been used for the intended purpose or have not been used or cared for in a reasonable manner or in accordance with any specific instructions issued with the product.

5.3- We cannot be held responsible for accidental damage, or loss of our products in full or in part.

6.5- You declare when ordering prescription lenses that your prescription is not more than 2 years old as governed by the supply of prescription spectacles laws in the uk, and is a valid prescription supplied by a qualified optician under 2 years old.
6.6- A binding contract is only entered into when we accept your order payment or deposit.

6.7- We reserve the right to use lens brands of our choice unless a lens brand has been specifically requested and documented on your order.

6.8- Descriptions like Bronze, Silver, Gold and Platinum are used to describe our lenses and are intended as a guide of quality and superiority and don't entitle the buyer to any particular lens brand unless specifically requested on order.

6.9- Frames chosen in-store are as chosen on the day after your careful consideration and as suitable for your needs.

6.10- frames not branded or sold as hypo-allergenic cannot be guaranteed against reactions to acids/acidic skin, colour loss etc.

 

7- Force Majeure

 

7.1-  in the event of unforeseen events or events beyond our control including but not limited to disasters, emergencies, exceptional weather conditions and strikes effecting production or completion, while the circumstances persist, the terms set here throughout shall be suspended until we or they are reasonably able to continue to perform the contract or contracts made without further undue delay.

 

8-  Statutory Rights

 

8.1- Nothing in these terms and conditions shall effect your statutory rights.​

​9- Eye Tests

9.1- We accept and undertake orders for prescription lenses and associated products in good faith of the prescriptions accuracy and that it will be suitable for your needs.

9.2- You declare you have supplied us a valid prescription supplied by a registered qualified optician that is two years old or less.

9.3- You declare you are 16 years old or over and not registered with the eye hospital when using our services.

9.4- You agree not to hold Ilkeston Factory Specs liable for remedy or refund If the prescription provided by you and your optician subsequently proves to be inaccurate or incorrect or unsuitable for your intended use.

9.5- We may at our discretion decide to perform a remedy in full or part whilst not being at fault when a wrong test is issued.

9.6- If we decide to authorise and agree to a free or discounted remedy due to the prescription issued to you by your Optician not being suitable, you agree to inform us of any re-test, remedy/replacement or financial enhancement offered or taken by you or via the original testing Optician and allow us to speak with the testing Optician to resolve the matter.

10- Pupil distance measurements

10.1- Pupil distance measurements and multifocal height settings are as we measure or feel are suitable and best practice when comparing existing glasses measurements and you agree to accept the measurements we assess or alternatively you may provide these measurements to us at point of order in-store which we will rely upon.

10.2- You accept that Pd's and height measurements may be altered slightly when you use our reframe service in-store and will not hold us responsible or liable for any subsequent effect this may cause.

11- Lens Brands

11.1- We reserve the right to use prescription lens brands of our choice unless you request a specific brand of lens which we will then document on your order docket.

11.2- Descriptions like Bronze, Silver, Gold and Platinum are used to describe the order and quality of the lenses used.

11.3- We do not guarantee comparisons to your unknown existing lenses.

12- Tints & Coatings

12.1- We reserve the right to use prescription lens coatings of our choice unless you request a specific brand. 

12.2- Exact tint shades and depths cannot be guaranteed and are not the "essence" of the contract made with Ilkeston Factory Specs for the supply of tints although we will take every care.

12.3- Exact colour depth of polarised lenses and react-to-light photochromic lenses when fully reacted vary from one brand to another and exact colour/depth does not form the "essence" of a contract made with Ilkeston Factory Specs. We will supply sun reactive lenses, widely used around the Uk of our choice unless otherwise stated on your order.

13- Reglazing & Reframing

13.1- When re-glazing your own frames we cannot accept liability for damage or breakage although we will take every care with your frames.

13.2- When reframing your lenses we cannot accept liability for any damage to your lenses or guarantee vision, pd and settings although we will take every care to work as closely and accurately as possible.

14- Deposits

14.1- Orders in store and payments/deposits made in store for full or part payment towards or in settlement of an order are non refundable and we reserve the right to pursue any balance payments if applicable and owed to us upon completion of your order.

14.2- You agree to perform to the terms of the contract and assist promptly if needed in aiding us to complete the contract.

14.3- You agree to make payment of any balance payment due to us upon our notice of completion (by email or telephone) of the contract (your order) without delay and within 2 weeks of completion.

15- Timescales

15.1- Time scales for completion of glasses are an estimate and don't form part of the "essence" of any contract made for the supply of products or services with Ilkeston factory specs.

16-  Responsibility

16.1- Frames purchase are your choice when placing an order and cannot be changed or altered by you at a later point without our agreement.

16.2- Lens brands we supply and you purchase from us are our choice of brand unless otherwise stated on your order.

17- Collection and Returns

17.1- You agree to inspect your glasses in-store on collection to ensure they are as described and free from minor defect and are suitable.

17.2- In the unlikely event that you later find a physical defect with your glasses/purchase you should let us know and not use the goods and return them to store as soon as possible and in any event within 7 days.

17.3- Returned frames or glasses should be unused and include all sundries, cases and receipts etc.

17.4- Damaged or faulty products cannot be returned if a claim of any sort has been made by you for some or all of the cost of the purchase and you agree to supply details of any claim made so that we can verify the claim directly and inform the person or company you have claimed from. If we can't confirm this or they do not intend on withdrawing the payment already made to you we won't enhance or make a refund to you.

​17.5- By using our services or making an order with us online or in-store you agree to be bound by the above mentioned terms.
